Explanation of terms
For the purposes of these General terms and conditions (in the following text: GTC), certain terms have the following meaning:
"Portal" - an online platform (online space), a catalog that creates the potential for a possible relationship between the Operator, the Advertiser and the User;
“Operator” - is the company H44, s.r.o., Horná 44, 974 01 Banská Bystrica, Slovak Republic, ID: 36053112, Tax ID: 2020095484, listed at the Commercial Court in Banská Bystrica;
“Advertiser” - is any natural or legal person, or their representative, who has registered on the Portal in order to order the advertisement of their services;
“User” - is any natural or legal person to whom the advertisement is intended (registered or unregistered); if the User is a natural person, he must be over 16 years old;
“Advertising” - are mainly online advertising services of promotion, search, evaluation and commenting that the Operator provides to mediate the supply and demand of goods and services between the Participating Parties, additional paid services, as well as other services that the Operator currently provides on the Portal;
“Advertiser and User” - in the following text, they are referred together as ”Participating Parties”;
“Advertiser interface” - web space intended for Advertiser;
“User interface” - web space intended for User;
“SOI” - the competent authority for control of the provision of Advertising services regulated by these conditions and related to them is Slovenská obchodná inšpekcia; SOI Inspectorate for Banská Bystrica county, Dolná 46, 974 01 Banská Bystrica, tel. no. 048/412 49 69, 048/415 18 71, bb@soi.sk.

Please read these GTC carefully before using this Portal. If you do not agree to these terms, do not use this Portal.
These GTC regulate the relations between the Operator under the domain name www.dobro-dosli.eu, other websites linked to it or otherwise connected, and the Participating Parties.
To whom the Portal is intended, the rights and obligations of its use
The operation of the Portal is not a form of travel agency that rents accommodation facilities in the name and on account of the lessor of accommodation, but serves as an online catalog of accommodation facilities in the territory of the Republic of Croatia and Bosnia-Herzegovina. It follows that it serves private accommodation providers or authorized representatives of accommodation providers in private for the promotion and advertising of apartments, studio apartments, rooms, hotels, hostels, villas, camps and other facilities in which accommodation services are provided for guests, or they offer related service activities with tourism, sports, recreation and relaxation.
The right to Advertising, access and use the Advertiser interface is exclusively owned by the owner of the accommodation facility - the Advertiser, and/or a person who is the authorized representative of the owner of the accommodation facility, and as such has all the necessary documents and permits for renting the accommodation facility.
The Portal enables direct communication between the Advertiser and the User who is interested in booking accommodation services. The Operator does not have information about whether the offer was accepted, or whether the User used the service of any Advertiser.
By paying the price for the Advertising in accordance with the published price list, the Advertiser has the right to present the facility and accommodation units located in this facility.
The User concludes the contract directly with the Advertiser, which means that the Operator is not one of the contractual parties in this relationship.
The content of this Portal is intended for the personal, non-commercial use of Users. Any other use of the content of the Portal, including but not limited to: downloading, modifying, publishing, transmitting, participating in the transfer or sale, copying, reproducing, republishing, creating derivative works, distributing, performing, displaying, incorporating into another website, reproducing the page ( whether by means of links, framing or in any other way) or in any other way use any content, in whole or in part, or repeatedly download and use for purposes other than those expressly permitted, may not take place without the prior express written consent of the Operator.
Content that is not owned by the Operator is used with the consent of its author/owner, who has the right to request their removal from the Portal at any time.
In case of violation of any of the stated conditions, your authorization to use this Portal and other websites linked to it or otherwise connected to it will automatically expire and you must immediately destroy any downloaded, uploaded or printed materials.
Data accuracy and completeness
The Portal exclusively promotes the data obtained from the Advertiser, while the Operator cannot guarantee the accuracy and completeness of the data on private accommodation if they do not correspond to the actual situation and bears no material or criminal liability for this.
The Advertiser is responsible for the promotion of his services and products and assumes full responsibility for the text and image information he places on the Portal in accordance with the Consumer Protection Act and guarantees their accuracy, completeness and truthfulness, as well as the quality, safety and legality of the products and services offered.
The Advertiser accepts the obligation to regularly make changes to the presented text and image information through the Advertiser interface, if such have occurred.
Disclaimer
The Operator fully disclaims responsibility for any loss or damage that was in any way connected with the use of the Portal, for any actions of the User related to the use or misuse of its content, as well as for any damage that may occur to the User, the Advertiser or a third party in this connection.
The Operator has no obligation to offer compensation or compensation for damages that the User may suffer through it, as a result of the payment and/or reservation of accommodation by the Advertiser.
In the event of a claim by a third party for damages related to the content provided by the Advertiser, the latter bears full responsibility, as well as the obligation to take all steps to defend and protect the Operator from such actions against him. In the event that the Operator suffers financial loss or incurs costs resulting from the materials and content provided by the User and/or the Advertiser, the User and/or the Advertiser undertakes to compensate them in full.
Links to third-party websites
This site may provide links to other third party websites. The Portal does not make any representations about any other websites accessed by the Participating Parties through this Portal.
Since the Portal has no control over such sites, the Participating Parties acknowledge and agree that the Operator is not responsible for the availability of these external sites and is not responsible for any content, advertising, products, services, or other materials on these sites. or of those available.
It is up to the Participating Parties to take precautions to ensure that whatever they choose for their use is free of items such as viruses, worms, trojans, malware and other items of a destructive nature. Use of such websites is at your own risk.
Protection of personal data and their use
We take the security of personal data very seriously, which is why we want it to be clear when we store which data and how we use it. We never misuse the personal data that you voluntarily leave on the Portal. The Operator undertakes to respect anonymity and privacy on it.
The User of the Portal agrees that the Operator collects his personal data:
- name and surname
- e-mail adress
- telephone/cellular number
The Advertiser of services on the Portal agrees that the Operator collects his personal data:
- name and surname
- address
- address of accommodation facility
- telephone/cellular number
- e-mail adress
- personal identification number
- website
- profile pictures
- pictures of the accommodation facility and accommodation units
- descriptive texts of the accommodation facility
- additional profile information (gender, language skills, other skills)
- additional information about services and products
According to the Act on the Prohibition and Prevention of Operating Unregistered Activities, "The customer of the Advertising is obliged to provide data proving its identity: company name and head office address, company ID, tax ID, name and surname of the responsible person or name and surname of the customer, his tax ID and permanent or temporary residence".
It is prohibited to publish advertisements if the Advertiser does not provide the above data from paragraph 3 of this article.
Furthermore, the Operator is obliged to collect the said data and store and process it in accordance with the Regulation on the protection of personal data (GDPR EU 2016/679 OF THE EUROPEAN PARLIAMENT AND COUNCIL dated 27.04.2016).
We will use the data provided to us exclusively in accordance with the above regulation and will only be used for the purposes of providing our products and services, or for other purposes for which you have given consent, unless otherwise required by law. We will use the given data exclusively to connect the User with the Advertiser and will not be used for any other purpose.

Right to exclusion
The Operator reserves the right, without compensation, for already paid Advertising, to exclude the Advertiser and/or User who in any way violates the GTC of use on the Portal, in any way interferes with the operation of the Portal, or in any way violates the rights of the Participating Parties, and this applies in particular to the User, who misuses the published information, or in any way makes unauthorized use of the content of the Portal, especially in the sense of: copying the published content and publishing it in/on another advertising medium, lobbying Advertisers for Advertising on similar websites or in other advertising media, or in any way by contacting and offering their services.
In this case, the Operator may, excluding such a User, demand compensation for the incurred damage or lost profit.
Discounts
Discounts are not cumulative.
Changes to these GTC
The Operator reserves the right to change these General Terms and Conditions of use of the Portal and other business conditions at any time without prior notice. The mentioned changes become effective upon publication on this Portal. In case of changes and/or additions to these GTC, the newer version of GTC replaces all previous versions.
